Introduction FainEra FZE respects your privacy and is committed to protecting your personal data. This Privacy Policy explains how we collect, use, store, share, and protect your personal data when you use the FainEra Fee platform. This Policy is drafted in compliance with the UAE Personal Data Protection Law (Federal Decree Law No. 45 of 2021, "PDPL") and applicable data protection regulations. By using FainEra Fee, you acknowledge that you have read and understood this Privacy Policy. Where we rely on your consent as the legal basis for processing, your continued use of the Platform constitutes your consent to the practices described in this Policy. 2. What Data We Collect We collect and process the following categories of personal data: 3.1 Account Information Data you provide when creating an account: full name, email address, and password (stored in encrypted form). 3.2 Exchange and Platform Identifiers The unique user identifiers (UIDs) you provide to connect your Partner platform accounts to FainEra Fee. These UIDs are used solely to track your cashback eligibility and calculate rebates. 3.3 Wallet Information The cryptocurrency wallet address(es) you provide for receiving cashback payments. FainEra does not have access to your wallet's private keys, balances, or transaction history beyond the cashback payments we send. 3.4 Transaction and Cashback Data Trading volume data, fee data, and cashback calculations received from Partner platforms through their affiliate systems. FainEra does not have access to your trading positions, balances, withdrawal addresses, or private keys. 3.5 Technical Data IP address, browser type and version, device type, operating system, time zone, and general location data (country level). This data is collected automatically when you access the Platform. 3.6 Usage Data Pages visited, features used, time spent on the Platform, click patterns, and navigation paths. This data helps us improve the Platform. 3.7 Communication Data Messages, emails, or inquiries you send to us through the contact form or other communication channels. 3.8 Referral Data If you participate in the referral program, we collect data about your referral link usage and the accounts registered through your referral. 4. Data We Do NOT Collect FainEra Fee does NOT collect or have access to: (a) Your trading positions, open orders, or portfolio holdings. (b) Your account balances on any Partner platform. (c) Your deposit or withdrawal addresses. (d) Your private keys, seed phrases, or wallet credentials. (e) Your payment card or bank account information. (f) Your government issued identification documents (unless required for a specific compliance process, in which case separate consent will be obtained). 5. How We Use Your Data We process your personal data for the following purposes and on the following legal bases: 5.1 To Provide the Service (Contractual Necessity) Calculating and distributing cashback, connecting your Partner accounts, maintaining your dashboard, and operating the referral program. 5.2 To Communicate with You (Contractual Necessity / Consent) Sending you account notifications, cashback updates, and responding to your inquiries. Marketing communications are sent only with your explicit consent and you can withdraw this consent at any time. 5.3 To Improve the Platform (Legitimate Interest) Analyzing usage patterns, fixing bugs, optimizing performance, and developing new features. We ensure our legitimate interests do not override your rights and freedoms. 5.4 To Ensure Security (Legitimate Interest) Detecting and preventing fraud, unauthorized access, and other security threats to the Platform and its users. 5.5 To Comply with Legal Obligations (Legal Obligation) Meeting our obligations under UAE law, including AML/CFT regulations, tax reporting, and responding to lawful requests from regulatory authorities. 6. Data Sharing We may share your personal data with the following categories of recipients: 6.1 Partner Platforms We share your UID with Partner platforms solely to verify your cashback eligibility and calculate rebates. We do not share your email, name, or other personal information with Partners unless required for a specific service you have opted into. 6.2 Service Providers We use third party service providers for hosting, analytics, email delivery, and customer support. These providers process data only on our instructions and are contractually obligated to protect your data. 6.3 Legal and Regulatory Authorities We may disclose your data to law enforcement, regulatory authorities, or courts when required by law or in response to a valid legal request. 6.4 Business Transfers In the event of a merger, acquisition, or sale of assets, your data may be transferred to the acquiring entity. You will be notified of any such transfer and given the opportunity to delete your account. We do NOT sell your personal data to any third party. We do NOT share your data with advertisers. 7. International Data Transfers Your personal data may be stored and processed on servers located outside the United Arab Emirates. Where data is transferred to a jurisdiction that does not provide an adequate level of data protection as determined by the UAE Data Office, we implement appropriate safeguards, including contractual clauses, to ensure your data remains protected in accordance with the PDPL. 8. Data Retention We retain your personal data for as long as your account is active and for a period of five (5) years after account closure, as required by UAE regulations relating to record keeping. After this retention period, your data will be securely deleted or anonymized. Specific retention periods: (a) Account information: Duration of account plus five (5) years. (b) Transaction and cashback data: Five (5) years from the date of the transaction. (c) Technical and usage data: Twelve (12) months from collection. (d) Communication data: Three (3) years from the date of the communication. 9. Data Security We implement appropriate technical and organizational measures to protect your personal data, including: (a) Encryption of data in transit (TLS 1.2 or higher) and at rest (AES 256). (b) Secure password hashing using industry standard algorithms. (c) Access controls limiting data access to authorized personnel only. (d) Regular security assessments and monitoring. (e) Incident response procedures for data breaches. No method of transmission over the internet or electronic storage is completely secure. While we strive to use commercially acceptable means to protect your data, we cannot guarantee absolute security. 10.
